Terms of service
Version 2026-10-20, in effect from 20 October 2026
Summary
- Bodylake keeps a private copy of your Apple Health app data in Germany so that AI apps you connect can read it.
- Bodylake gives no medical advice. Answers come from the AI app you choose and can be wrong.
- Apple sells the subscription; cancellation and refunds go through Apple.
- You can end the contract at any time by deleting your account. Your rights as a consumer stay as the law gives them.
The sections below are the full terms.
Who we are
Bodylake is provided by Sascha Schwabbauer, trading as Bodylake, c/o POSTFLEX PFX-318-277, Emsdettener Straße 10, 48268 Greven, Germany. For questions, complaints and claims, call +49 152 079 92 398 or write to hello@bodylake.com.
What Bodylake is and isn’t
Bodylake copies the data in your Apple Health app, with your permission, to a private store in Germany that is encrypted with a key of your own. AI apps that you connect, such as Claude or ChatGPT, can then read that copy, and only read it. Bodylake has no AI of its own.
Bodylake is not a medical device and gives no medical advice, diagnosis or treatment. The answers you get come from the AI app you choose, not from us, and they can be wrong. We don’t control what an AI app makes of your data; for our own service we are liable as set out under “Liability”. Your copy can be incomplete or a little behind the Health app. Talk to a doctor before you make medical decisions, and in an emergency call your local emergency number.
How the contract is made
You conclude the contract in the Bodylake app. First you read these terms and accept them on their own step. On the next step, separately, you give your consent to the processing of your health data. Then you enter your email address, confirm it with the code we send you and create a passkey. Until you create the passkey, you can go back and correct what you entered. The contract is made when your passkey is created and your account exists. You can conclude it in English or German.
We store the text of these terms; it stays available at bodylake.com/terms and bodylake.com/nutzungsbedingungen. We confirm the contract by email.
Your account
You must be at least 18 years old. An account is for one person and for your own data only: copy no one else’s data without their authority. Each family member who uses Bodylake through Family Sharing needs their own account and gives their own consent. Keep your passkeys safe, and tell us straight away if you think someone else is using your account.
Subscription
Apple sells the Bodylake subscription through the App Store. In the US, Canada, Australia, New Zealand, Japan, Latin America and the Caribbean, Apple sells it on our behalf; everywhere else, including the EU, the UK and Switzerland, Apple sells it in its own name. The free trial, prices, Family Sharing, billing, cancellation, refunds and any right of withdrawal are handled by Apple under Apple’s terms. You cancel the subscription in your Apple account settings. Deleting your Bodylake account doesn’t cancel it.
Bodylake learns from Apple which plan you have, whether the free month is running, whether and at what price your subscription renews, when it ends, and about refunds and the end of Family Sharing. A subscription covers one Bodylake account at a time: if you use it for another Bodylake account, this account’s access ends. When your subscription ends or moves to another account, your data stays for 30 days in case you come back; we warn you 7 days before we delete it.
AI apps and other services
To use your data with an AI app, you need an account with that app’s provider. Its terms and privacy policy apply, and you must follow them, as well as Apple’s terms for the App Store and your devices. You choose which AI apps to connect. Their providers, not we, run those services and produce their answers. You can disconnect an AI app at any time under Connected AIs in the app.
Fair use
You may not:
- attack Bodylake, its servers or other people’s accounts, or try to reach data that isn’t yours;
- get around our limits on requests or the read-only access of AI apps;
- reverse engineer the app or the service beyond what the law allows;
- use Bodylake for anything unlawful.
Availability, updates and changes
We keep Bodylake running and secure and provide the updates needed for that while your subscription lasts. Short interruptions for maintenance or for reasons outside our control can happen. Install app updates when they come out. If you don’t install an update that we told you about, together with what happens without it, and a problem arises only because of that, we are not responsible for that problem.
We change the service only for good reasons: new legal requirements, security, changes by Apple or the AI app providers, or new features. A change costs you nothing extra, and we tell you about it beforehand. If a change makes Bodylake more than slightly harder to use, we tell you at least 30 days ahead, and you can end the contract.
If we want to change these terms, we show you the new version in the app and ask you to accept it. We never treat your silence as acceptance. If you don’t accept, the current terms continue to apply, and either of us can end the contract as described in “Ending the contract, suspension and deletion”.
Warranty
Your statutory rights for defects apply. If the app doesn’t do what we promise, you can also notify Apple, which refunds the price you paid for it.
Liability
We are liable without limit for intent and gross negligence, for injury to life, body or health, under a guarantee we gave, and under the German Product Liability Act. For slight negligence we are liable only if we breach an essential obligation, that is, an obligation that makes the contract possible in the first place and on which you regularly rely, and then only for damage that is typical and foreseeable for this contract. Otherwise we are not liable.
Ending the contract, suspension and deletion
You can end the contract at any time by deleting your account in the app (Delete Account). Your Apple subscription is separate; cancel it with Apple.
We can end the contract with at least 30 days’ notice, and not before the end of a subscription period you have already paid for. You can export your data until the contract ends. If we stop offering Bodylake altogether before a paid period ends, you get back the price for the unused part through Apple. We can end the contract without notice for good cause (§ 314 of the German Civil Code).
We may suspend your account if it threatens the security of Bodylake or of other people’s data, if it is used against these terms, or if the law requires it. We tell you why, give you a chance to respond and lift the suspension once the reason is gone. We don’t review or moderate your data; we act only on orders from authorities or valid notices of illegal content, which you can send to hello@bodylake.com.
If you don’t start a subscription within 7 days of creating your account, the contract ends and we delete the account, which holds no health data by then.
What happens to your data when the contract ends is in our privacy policy.
Law and disputes
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer, you keep the protection of the mandatory law of the country where you live. We are neither willing nor obliged to take part in dispute resolution proceedings before a consumer arbitration board.
Additional terms for the App Store version
For the Bodylake app from the App Store, these terms also say:
- These terms are between you and us, not Apple. We, not Apple, are solely responsible for the app and its content.
- You get a non-transferable licence to use the app on Apple-branded products that you own or control, as the Usage Rules in the Apple Media Services Terms allow. Other accounts associated with the purchaser can use it through Family Sharing or volume purchasing.
- We alone provide maintenance and support, as these terms or the law require. Apple has no obligation to provide any.
- We are responsible for any warranties, as far as the law doesn’t exclude them. If the app doesn’t conform to a warranty, you can notify Apple, and Apple refunds the purchase price. As far as the law allows, Apple has no other warranty obligation, and other claims arising from it are our responsibility.
- We, not Apple, handle any claims relating to the app, including product liability, failure to meet legal or regulatory requirements, and claims under consumer protection, privacy or similar laws, including those connected with the app’s access to the Health app. Nothing in these terms limits our liability beyond what the law allows.
- If someone claims that the app or your use of it infringes their intellectual property, we, not Apple, are responsible for investigating, defending, settling and discharging that claim.
- You may not use the app if you are in a country that is subject to a US government embargo or that the US government has designated as supporting terrorism, or if you are on a US government list of prohibited or restricted parties.
- Questions, complaints and claims about the app go to us: Sascha Schwabbauer, c/o POSTFLEX PFX-318-277, Emsdettener Straße 10, 48268 Greven, Germany, +49 152 079 92 398, hello@bodylake.com.
- You must follow the terms of third parties that apply when you use the app, such as your AI app provider’s.
- Apple and its subsidiaries are third-party beneficiaries of these terms and can enforce them against you.
Languages
These terms are available in English and German. Both versions are equally binding. The version in the language in which you concluded the contract applies to you.
Severability
If a provision of these terms is invalid, the rest stays valid, and the statutory rules apply in its place (§ 306 of the German Civil Code).
